For couples, married or not, where one parent is not the birth or biological parent of the child they are raising together.

In plain words

Marriage gives many couples a legal presumption that both spouses are parents. A presumption is helpful, but it is not a court judgment, and not every state or country treats it the same way.

A second-parent adoption, or a confirmatory adoption for married couples, gives the nonbirth or nonbiological parent a judgment that courts everywhere are used to recognizing. Many families call it peace of mind on paper.

We use the words your family uses. Mama and Mom, Papa and Dad, Baba, or something all your own.

Situations we help with

  • Two moms after donor conception
  • Two dads, alongside a parentage judgment
  • Married couples who want a judgment
  • Unmarried partners raising a child
  • Families planning to move or travel abroad
  • Trans and nonbinary parents
  • Children born before a marriage
  • Updating birth certificates

Step by step

How it usually goes

  1. 1

    A free 20-minute call

We ask how your child joined the family and whether you are married or registered partners. That decides which filing fits.

  2. 2

    Gather a few documents

Usually a birth certificate, a marriage or partnership certificate and records from your clinic or donor agreement. We send a short checklist.

  3. 3

    File the petition

Some confirmatory adoptions can skip a home visit. We tell you whether yours can, and prepare everything for the court.

  4. 4

    The hearing

Some courts hold these by video. Either way, we are there with you.

No promised dates

No lawyer can promise an outcome or a date. Courts, agencies, clinics and other states all move at their own pace. We tell you what we know, when we know it. Things that often change the pace:

  • The court's calendar
  • Home study scheduling
  • Another state's approval
  • A party who is hard to reach
  • Medical timing
  • Records from a clinic or agency
  • Another country's paperwork

Example fee

$2,200 to $4,000

Flat fee, example range. Confirmatory adoptions for married couples usually sit near the low end.

Included

  • Document checklist and review
  • Petition and consents
  • Court filings
  • The hearing

Paid separately

  • Court filing fees
  • Any home visit fee, if the court requires one
  • Certified copies of the judgment

Your exact fee is in your plan letter before you sign. Payment plans are available. All fees

Rules differ by place

Some states offer second-parent adoption, some offer confirmatory adoption, and some offer neither. A judgment from a California court is generally respected elsewhere, but if you plan to move, tell us where.

We practice California law, and bring in licensed local counsel when another state or country is involved.

General information

This website is general information, not legal advice. Reading it, calling us or sending a form does not make Kith & Kin your lawyer. That happens only when we both sign an engagement letter.

Questions about second-parent adoption

We are married. Do we really need this?

Not every family does. But a presumption can be questioned, especially across state lines or in a future custody case, and a judgment is much harder to question. We help you weigh it.

Is this the same as a stepparent adoption?

They are cousins, not twins. A second-parent adoption keeps both parents' rights in place and fits families who planned a child together. We choose the right filing for your facts.

Can we do this if we live outside California?

We file in California courts. If your family lives in another state, we can connect you with counsel there.
