Alternatives to bankruptcy

Bankruptcy is one tool, not the only one. Sometimes the best advice is not to file, and we will say so.

What it is, in plain words

At every consultation we look at the options outside bankruptcy too. If your debts are small, your income is protected from collection, or a creditor will accept a fair deal, filing may cost more than it saves.

You will leave with an honest side-by-side comparison, even if it means you do not hire us. That is the point of a free consultation.

Worth a look if

  • Most of your debt is one or two accounts
  • Your income and property are protected from collection
  • You could afford a reduced lump sum or a short payment plan
  • You filed recently and cannot file the same chapter again yet

Watch out for

  • Forgiven debt can sometimes count as taxable income
  • Settlement companies that charge before results can leave you worse off
  • Ignoring a lawsuit can lead to a judgment and a garnishment

The options, side by side

  • Negotiate with creditors

Can help with: Can settle an account for less, or set up a payment plan

Watch for: Creditors do not have to agree; forgiven debt may be taxable

  • Nonprofit credit counseling plan

Can help with: One monthly payment, often at lower interest

Watch for: Usually 3 to 5 years, and you repay the full balance

  • Loan modification

Can help with: Can lower a mortgage payment and keep the house

Watch for: Paperwork-heavy, and lenders can say no

  • Waiting it out

Can help with: If income and property are protected, collection may not reach you

Watch for: Calls and lawsuits can continue while the debt is still collectible

  • Bankruptcy

Can help with: Court protection and a legal discharge of many debts

Watch for: Can stay on your credit report for 7 to 10 years; fees and paperwork

General comparison only. The right choice depends on your debts, income, property and goals.

Alternatives

Questions people ask us

Should I use a debt settlement company instead?

Be careful. Some charge large fees up front and ask you to stop paying creditors, which can lead to lawsuits. If settlement makes sense, we can negotiate directly for a flat fee and you keep control.

What does judgment-proof mean?

It means a creditor could win a judgment but still could not collect, because your income and property are protected by law. For some people, that makes filing unnecessary for now.

Will you really tell me not to file?

Yes. If an alternative is cheaper and safer for you, we will say so in writing. People remember who gave them an honest answer.
