Life care planning

What a life care plan is, who writes it, and why it decides whether a settlement lasts a lifetime.

How the plan works

If someone is in the hospital tonight

You don't need a lawyer at the bedside. These six steps protect your family while you focus on them.

We come to the hospital, the rehab unit or your kitchen table

The first conversation is free and has no time limit. One of our four attorneys comes to you, with our nurse case manager when it helps. You can bring whoever you like, and you never have to explain the same thing twice.

How a case like this works

  1. Step 1: We listen

A free, unhurried conversation, by phone or in person at the hospital, rehab unit or your home. No forms to fill in first.

  2. Step 2: We protect the evidence

Preservation letters, scene inspections and records requests start within days, so nothing important is lost.

  3. Step 3: We plan for a lifetime

Doctors, a life care planner and an economist work out what this injury will cost over the years ahead.

  4. Step 4: We resolve it, or try it

Most cases settle. If a fair offer does not come, we go to trial. You decide, with our honest advice.

What it costs your family

  • No fee unless we recover

Our fee is a percentage of any recovery, usually 33 to 40 percent depending on the stage, set in writing before you sign anything.

  • We pay the case costs

Experts, records, testing and court costs are paid by us as the case goes. If there is no recovery, you owe us nothing for them.

  • Clear numbers at the end

Before any money changes hands, you get a written statement showing the recovery, the fee, the costs and what goes to your family.

Example outcomes

These are example outcomes written for this sample site. They are not real cases. Every case is different, and no lawyer can promise a result. Past results do not guarantee or predict the outcome of any future case.

Example outcome Brain injury

A teacher's concussion that was not mild

Settled before trial

A rear-end crash left a middle school teacher unable to manage a classroom. Her scans were normal. Neuropsychological testing showed lasting attention and memory loss, and her husband's daily journal showed what that looked like at home.

Example outcome Amputation

A modest result, honestly explained

Settled for the policy limit

A delivery driver lost part of his foot when a forklift operator at a small warehouse backed into him. The warehouse carried a small insurance policy and had few other assets.

Example outcome Spinal cord injury

A case we lost at trial

Jury verdict for the defense

A diver was injured at a private lake. We argued the owner should have posted depth warnings. The jury decided the owner was not responsible.
