Wrongful death

For families who have lost someone, and want answers without having to fight alone.

A young woman sits on a sofa with her arm around her mother, comforting her

If you have lost someone

We are so sorry. Nothing we do will bring them back, and we will never pretend otherwise. What we can do is find out what happened, hold the right people responsible and protect your family's future.

You do not need to decide anything this week. Many families call us weeks or months after a death, once the shock gives way to questions. Some deadlines are short, though, so a quiet first conversation is worth having early.

We are glad to talk with one family member or with several. Families often have different feelings about a case, and that is normal. We make room for all of them.

Who can bring the claim, and how

A wrongful death claim belongs to the family, but it is brought through the estate. These are the terms you will hear.

Personal representative
The person a court appoints to act for the estate, often named in the will. They bring the case on the family's behalf. If no one has been appointed yet, we help with that step.
Wrongful death claim
A claim for the family's own losses: the income and support they lost, the services the person gave, and the costs of the funeral.
Survival action
A separate claim, filed alongside, for what the person who died went through between the injury and death, such as pain and medical bills.
Beneficiaries
In Pennsylvania, usually the spouse, children or parents. The law and sometimes the court decide how money is shared.
Filing deadline
In Pennsylvania most claims must be filed within two years of the death. Claims involving a government agency can need written notice within six months.

How these losses happen

  • Car, truck and motorcycle crashes
  • Medical errors and missed diagnoses
  • Workplace accidents
  • Neglect in nursing homes and care facilities
  • Defective products
  • Fires, drownings and unsafe property

Answers, at your pace

Finding out what really happened is often what families want most. We gather records, reports and expert opinions, and we share what we learn with you in plain words, at a pace that suits you.

How we investigate

What a wrongful death claim can cover

Pennsylvania splits these between the wrongful death claim and the survival action. We file both where the law allows.

  • Funeral and burial costs
  • Medical bills from the final injury or illness
  • The income and support your family lost
  • The care, guidance and services your loved one gave
  • Their pain and suffering before death, through the survival action

How we handle a wrongful death case

  1. We start with the estate

If no personal representative is in place, we work with you and a probate attorney to get one appointed, so the case can be filed on time.

  2. We find out what happened

We collect reports, records and video and consult experts. We tell you what we learn, and you choose how much detail you want.

  3. We value the life, not just the paycheck

An economist measures lost support. Family members and friends help us show who this person was.

  4. We keep everyone included

When several relatives are involved, we keep each one informed and explain how any recovery will be shared.

What helps right now

Small things families can do this week. None of them need a lawyer.

More in our family resources

  1. Keep the death certificate, police report and any hospital records you receive.
  2. Find the will, if there is one, and note who is named as executor.
  3. Do not talk to the other side's insurer about what happened.
  4. Look after yourselves. Grief support resources are listed on our family resources page.

Questions families ask

All questions

Who in the family should call you?

Anyone can make the first call. We will explain who has the legal right to bring the case and help the family decide together.

We don't have an executor yet. Is it too early?

No. Many families call before the estate is opened. We can guide you through that step and coordinate with a probate attorney.

Will this mean a trial?

Most cases settle, but we prepare every case as if it will go to trial. You will decide, with our advice, whether to accept any offer.

Example outcomes

These are example outcomes written for this sample site. They are not real cases. Every case is different, and no lawyer can promise a result. Past results do not guarantee or predict the outcome of any future case.

Example outcome Wrongful death

A father lost to a missed warning sign

Settled during trial preparation

A 52-year-old man died of a heart attack after being sent home twice from an urgent care clinic. The estate had not been opened; we coordinated with a probate attorney so the claim was filed in time.

What it meant: The recovery was shared by his wife and two adult children under a court-approved plan.
