Questions families ask

Straight answers to the questions we hear most often. If yours isn't here, call us. There's no charge to ask.

Getting started

I'm calling for my husband, who can't talk right now. Is that okay?

Yes. Most of our first calls come from a family member. Tell us what you know, and we will speak with your husband when he is able.

Is the first conversation really free?

Yes. There is no charge to talk with us, and no obligation to hire us. If we don't think we can help, we will say so and suggest who might.

Can you come to the hospital?

Yes. We visit hospitals, rehab units and homes across Western Pennsylvania, eastern Ohio and northern West Virginia, including evenings and weekends.

What should I bring or gather?

Nothing is required. If you have them, discharge papers, a police report, photos and any insurance letters are helpful. We can get the rest.

Fees and costs

How do you get paid?

Through a contingency fee: a percentage of any recovery, usually 33 to 40 percent depending on how far the case goes. It is set in writing before you sign.

Who pays for experts and records?

We do, as the case goes along. Catastrophic cases can need many experts. If there is no recovery, you do not repay those costs.

Will I get a bill in the middle of the case?

No. You will never get a bill from us during the case.

Time and the process

How long will this take?

Serious injury cases often take two to four years. We will not rush to settle before the long-term medical picture is clear, because a settlement has to last a lifetime.

How much do I have to do?

As much or as little as you can manage. We handle the legal work. We may ask you for a journal of daily life, some records and, later, your time to prepare for a deposition.

How will I know what is happening?

You get a named attorney and a nurse case manager, and a check-in call every two weeks. You can call between those any time.

Is there a deadline?

Yes. In Pennsylvania most injury and wrongful death claims must be filed within two years. Claims involving a government agency can need written notice within six months. Other states differ. Call early so we can check your dates.

Families and decisions

What if our family disagrees about bringing a case?

That is common. We are glad to meet with several family members, answer everyone's questions and give the family time to decide.

My father can't make decisions for himself. Who signs?

It depends on whether he has a power of attorney or needs a guardian. We will explain the options and help you through the steps.

Will a settlement affect disability benefits or Medicaid?

It can. We work with benefits and trust lawyers so a recovery can be structured to protect needed benefits where possible.
