Ninebark Family law for parents

For parents

Enforcement

When an order isn't being followed, or when you're the one facing a contempt motion.

An order only helps if it is followed. When support goes unpaid or parenting time keeps getting cancelled, there are steps between doing nothing and a courtroom fight. We start with records and a firm letter, then use the court's enforcement tools when needed. We also defend parents facing a contempt motion or a wage-withholding notice, because there is often more to the story.

Who usually calls us about this

Support is unpaid

Payments stopped, or come late and short.

Your time is being denied

Exchanges are cancelled or the plan is ignored.

You are facing contempt

You were served with a contempt motion or a withholding notice and want to respond.

What we do

  1. 1 Help you build a clean record of missed payments or exchanges
  2. 2 Send a firm, factual letter before going to court
  3. 3 File contempt or enforcement motions when they are the right tool
  4. 4 Coordinate with the state support agency when it is already involved
  5. 5 Defend parents who are behind for real reasons, and propose workable payment plans

How Washington usually handles it

In general terms. Your facts, your county and recent changes in the law all matter, so ask us how this applies to you.

  • Courts can order make-up parenting time, payment of back support and, in some cases, other remedies.
  • The state support agency can collect support through wage withholding and other tools.
  • Contempt usually requires showing the other parent could have followed the order and chose not to.
  • Back support generally can't be erased, but a fair plan to repay it can often be set.

What to bring

  • The order being violated
  • Payment records or a log of missed exchanges
  • Messages about the missed payments or visits
  • Any notices from the court or the support agency

The honest part

Enforcement can fix a pattern, but it rarely fixes a relationship. We will help you choose the step that protects your child's routine, not just the one that feels best this week.

We never promise a custody, parenting time or support outcome. Anyone who does is guessing.

An example of how this can go

Example outcome Agreed after filing

Missed exchanges, fixed without a trial

Lincoln County ยท About 2 months

Situation. A father's weekends were being cancelled most months, always at the last minute.

What happened. A demand letter and one contempt motion led to an agreed order with make-up time and a fixed exchange spot at a public location.

Example outcomes are illustrations for this demo, based on common situations. Every family and every case is different. Past results do not predict or guarantee the result of any future case, and nothing here is legal advice. More example outcomes

Common questions

Can I keep my child from visiting if support isn't paid?

No. Parenting time and support are separate. Withholding a child can put you in contempt. Use the enforcement process instead, and we can help.

I'm behind on support. What should I do first?

Keep paying what you can, keep records, and get advice before a hearing. If your income changed, a modification may also be needed.
