Fees
How much does a real estate closing attorney cost in Charleston?
At Tidemark, a buyer's purchase closing with a loan is a flat fee from $995 to $1,250, a cash purchase from $850 to $1,050, a seller's side from $450 to $650 and a refinance from $650 to $850. You get the exact figure in writing within one business day.
What is not included in your fee?
Title insurance premiums, county recording charges, your lender's fees, prepaid taxes and insurance, surveys and HOA charges. Our closing costs page shows example ranges for each, labelled as examples.
Do you charge for a consultation?
Closing quotes are free. Title, lease and dispute consultations are $150 for 45 minutes, credited to your fee if you hire us.
Closings
Do I need a lawyer to buy a house in South Carolina?
South Carolina is an attorney closing state, so a licensed South Carolina attorney must supervise a home purchase or refinance closing. Rules differ in other states.
Can I pick my own closing attorney?
Yes. The buyer can choose. Tell your agent and lender early so documents come to the right office.
What do I bring to closing?
A government photo ID and the funds shown on your statement by wire or certified check. We confirm wiring instructions by phone, never by email alone.
Can I close if I'm out of town?
Yes. We arrange mail-away signings with a notary near you, and courier the documents both ways.
Title
Is owner's title insurance worth it?
It is optional and paid once. It protects you, not your lender, against covered title problems that no search could find. We explain what it covers so you can decide.
Can you promise my title is clean?
No. We can tell you what the record shows and fix what we find. Title insurance is what protects against what nobody found.
Leases and commercial
Do you represent landlords or tenants?
Both, never on the same lease. We run a conflict check first.
How do commercial fees work?
Contract reviews and lease work are mostly flat fees. Full acquisitions get a written estimate with the assumptions listed, updated before anything changes.
Disputes
Can you tell me if I will win?
No one can promise an outcome. We tell you what the documents show, the strong and weak points, and what each path costs.
I was served with papers. What now?
Call the day you receive them. Court papers come with response deadlines, and some are short.
1031 exchanges
What are the 1031 deadlines?
Under federal rules you identify replacement property in writing within 45 days of selling, and close within 180 days, or by your tax return due date if that comes first. Your CPA confirms how the rules apply to you.
Do you give tax advice?
No. We handle the real estate side and work with your CPA and qualified intermediary, who handle the tax and exchange sides.
Working with us
Where do you practise?
Tidemark's attorneys are licensed in South Carolina only. We close in Charleston, Berkeley and Dorchester counties. For property in another state, we can suggest how to find a local attorney.
Does contacting you make you my lawyer?
No. We become your lawyers once we confirm there is no conflict and you sign an engagement letter. Please don't send confidential details through the website form.
