Gun charges in Virginia run from a misdemeanor to a serious felony. The same gun can lead to very different charges, depending on where it was, who it belonged to, and your record.

Marcus Wray leads our gun cases. Many of them begin at a traffic stop, which he knows well from six years as a prosecutor. He looks first at why you were stopped, how the gun was found, and whether the search followed the rules.

Charges we handle

  • Concealed carry without a permit
  • A gun found in a car
  • Possession after a felony
  • Brandishing a firearm
  • Reckless handling of a firearm
  • Guns and protective orders
  • Substantial risk order hearings
  • Federal cases: review and referral

What a gun charge means, in plain words

Most gun charges ask one of three questions. Were you allowed to have the gun? Were you allowed to carry it the way you did, in the place you did? Was it shown or used in a way the law forbids?

Some people may not have a gun at all, for example after a felony conviction or while certain court orders are in place. For them, simply having one can be a crime, even if it was never fired or shown to anyone.

Having a gun does not always mean holding it. The state may say a gun in your car or your home was yours. It still has to prove you knew it was there and could control it.

What could happen

  • Some gun charges are misdemeanors. Others are felonies, and a few carry mandatory jail time if you are convicted.
  • A felony conviction usually means you can no longer legally own or carry a gun.
  • A conviction can cost you a concealed handgun permit, and it can affect some jobs.
  • Police usually keep the gun while the case is open. Whether it comes back depends on how the case ends.
  • A gun charge added to another charge, such as a drug charge, can make the whole case more serious.

Every case is different. The real range for you depends on the exact charge and your record. General information, not legal advice for your situation.

What to know right now

  1. 1 Do not tell police where the gun came from or who owns it. Say you want to talk to a lawyer first.
  2. 2 If a court order tells you to give up your guns, follow it on time. Call us so it is done the right way.
  3. 3 Keep any permit, purchase papers or receipts for the gun. They can matter.
  4. 4 If federal agents are involved, tell us on the first call. Federal cases follow different rules.

How we build the defense

  • Check whether the officer had a lawful reason for the stop and for the search.
  • Ask the court to throw out a gun found during an unlawful search.
  • Get body camera and dash camera video early, before it can be lost.
  • Look at who else used the car or home where the gun was found.
  • Check the records behind any claim that you were not allowed to have a gun.
  • Raise self-defense where the facts support it.

We can't promise how your case will end. We can promise to check every one of these, explain what we find, and let you make the call.

Questions about gun charges

The gun was in my car, but it was not mine. Can I still be charged?

Yes, you can be charged. But the state still has to prove you knew the gun was there and could control it. Who owns the car, who else rode in it, and where the gun was found all matter.

Will I get my gun back?

Maybe. Police usually hold a gun while the case is open. Whether it comes back depends on how the case ends and whether you are allowed to own one. We raise it at the right time.

What if my case is in federal court?

We handle state cases. If agents say your case is federal, call us anyway. We will look at where things stand and connect you with federal defense lawyers we trust.
