How this estimate is calculated
Adjusters and plaintiff lawyers both first-pass a claim the same way: economic damages, plus pain and suffering estimated as a multiple of the medical specials, adjusted for fault.
estimate = (medical specials × severity multiplier + lost wages) × recoverable-fault share
- Multiplier: ~1.5× for minor injuries that heal fully, up to ~5× for permanent, life-altering harm.
- Medical specials: your bills if you enter them (with up to 1.4× headroom for reasonable future care); otherwise a typical range for your treatment level.
- Fault share: New York reduces recovery by your percentage of fault (CPLR 1411) — partial fault is not a reason to give up a claim.
- Rounding: to the nearest $500, because false precision is its own kind of lie.
