Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of services provided by SearchPod Inc. ("SearchPod," "we," "us," or "our"). By signing a service agreement or engaging with our services via https://searchpod.com, you (“Client,” “you,” or “your”) agree to these Terms.

If you do not agree with any part of these Terms, you may not use our services.

2. Services Offered

SearchPod provides a range of digital marketing services including but not limited to:

  • Google Ads and Meta (Facebook/Instagram) Ads management
  • Reddit advertising and campaign strategy
  • Google Analytics & Tag Manager setup and monitoring
  • SEO and keyword planning
  • Custom landing pages and websites
  • Marketing audits
  • Email marketing campaigns (Mailchimp and other tools)
  • Free consultations and occasional free trials

Specific deliverables will be outlined in a signed agreement between SearchPod and the Client.

3. Payment Terms

  • All services are billed on a month-to-month subscription basis, unless otherwise stated in a written agreement.
  • Payments are typically processed via Stripe, with eTransfers accepted on a case-by-case basis.
  • Full payment is due by the date stated on your invoice.
  • If payment is not received within 60 days, a late fee may apply, and services may be paused or terminated.

4. Refund Policy

SearchPod offers a 30-day satisfaction guarantee. If you are not satisfied with the results delivered in the first 30 days, you may request a refund for fees paid during that period.

Refunds are not guaranteed for services rendered beyond the initial 30-day period, but may be granted at SearchPod's discretion if results are deemed unsatisfactory.

5. Ownership of Deliverables

  • Clients retain ownership and access to their own advertising accounts (e.g., Google Ads, Meta Business Suite).
  • Any websites or digital assets built by SearchPod remain the property of SearchPod unless otherwise stated in a signed contract.
  • If the agreement is terminated and ownership is not granted in writing, access to hosted websites and related assets will be revoked.

6. Client Responsibilities

To ensure effective service, the Client agrees to:

  • Provide timely access to advertising accounts, assets, and relevant business information
  • Maintain valid and up-to-date billing information
  • Not misuse or alter advertising or analytics setups without consultation
  • Comply with all advertising platform policies (Google, Meta, etc.)

7. Limitation of Liability

SearchPod is not liable for:

  • Platform-level policy changes or account suspensions (e.g., by Google or Meta)
  • Technical errors or downtime from third-party providers
  • Any indirect, incidental, or consequential damages from use of services

While we aim to improve marketing performance, we do not guarantee specific revenue or traffic outcomes.

8. Termination

Either party may terminate services with written notice, subject to the terms outlined in the service agreement. Upon termination:

  • Final billing adjustments will be issued
  • Website access will be revoked unless otherwise agreed
  • Advertising account access remains with the Client

9. Governing Law

These Terms are governed by the laws of the Province of Ontario, the federal laws of Canada, and—where applicable—the relevant consumer protection laws of the United States.

By using our services, you acknowledge that any disputes will primarily be resolved under Canadian law, and any legal action will be brought in the courts of Toronto, Ontario, unless otherwise required by law.
